On Monday, District Court Judge Thomas Willmore read an order that declared Heidi Rutchey incompetent to stand trial for the murder of her son, Eli Rutchey.

42-year-old Rutchey came to Logan Regional Hospital seeking medical treatment on Sept. 4, 2013 where staff learned of the toddler and notified law enforcement.

Cache County Sheriff’s deputies found the two-year-old dead in Rutchey’s apartment later that day. Autopsy reports indicated that the child had been deceased for at least 10 days.

Rutchey was booked into Cache County jail on $100,000 bail Oct. 24, 2013.

In a probable cause statement released by the attorney’s office after her arrest, investigators say Rutchey caused her son’s death by suffocating him and that Rutchey tried to take her own life with an overdose of medication.

Reports say Rutchey was removed from the courtroom while waiting for her case to be called, Monday, ranting about Palestine and threats to her family. Judge Willmore demanded that Rutchey stop talking or be dismissed from the courtroom again.

Rutchey was found incompetent by two examiners and she will be moved to the Utah State Hospital in Provo to try and restore competency.
